Terms of Service

1. Service Description

CraftAndShip is a web application creation platform. You describe a web application in plain English through our chat-based intake process. We use artificial intelligence (powered by Anthropic's Claude) to generate a structured specification, build the application, test it, and deploy it to cloud infrastructure (Railway). The resulting application is a fully functional web app hosted and accessible via the internet.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@craftandship.io if you become aware of any unauthorized use of your account.

4. Payment Terms

CraftAndShip offers paid tiers for app creation. All prices are listed in US Dollars. Payment is processed through Stripe. By submitting payment, you authorize us to charge the applicable fees.

• Non-refundable after build starts. Once your build has been queued and processing begins, the build fee is non-refundable.
• Refund for failed builds. If we are unable to successfully build your application and cannot resolve the issue, you are entitled to a full refund of the build fee.
• Hosting fees. After the included hosting period, monthly hosting fees are billed in advance. You may cancel hosting at any time; cancellation takes effect at the end of the current billing period.
• Cancellation. You may cancel a build request at any time before it enters the build queue for a full refund. Once the build has been queued, cancellation is not available and the non-refundable policy above applies. To cancel hosting, contact support@craftandship.io; your app will remain live through the end of your current paid period.
• Disputes. If you believe a charge is incorrect, contact us at support@craftandship.io within 30 days of the charge. We will review the dispute and respond within 5 business days. If we cannot resolve the dispute, you may escalate through your payment provider.
• Promotional pricing. From time to time, we may offer promotional or beta pricing at reduced rates. Promotional prices are valid for the duration stated at the time of purchase and apply only to new builds placed during the promotional period. Standard pricing resumes when the promotion ends.

5. Ownership of Generated Code

You own the application code generated by CraftAndShip for your project. Upon successful delivery, all intellectual property rights in the generated application code are assigned to you. This does not include any underlying platform code, tools, libraries, or infrastructure used to build or host the application.

6. Our Right to Use Anonymized Data

We retain the right to use anonymized, aggregated data derived from your use of the Service (such as general patterns in app specifications, build metrics, and usage statistics) to improve and develop the Service. This data will not identify you or your specific application.

7. Acceptable Use

You agree not to use the Service to:

• Create applications that contain or distribute illegal content
• Build apps that infringe on the intellectual property rights of any third party
• Generate applications designed for fraud, phishing, or deception
• Create apps that distribute malware or engage in unauthorized data collection
• Violate any applicable law or regulation
• Attempt to reverse-engineer, interfere with, or disrupt the Service

8. Your Responsibilities

You are solely responsible for the content, functionality, and legal compliance of the applications you create through the Service. This includes ensuring your app complies with all applicable laws, does not infringe third-party rights, and includes any required disclosures (such as privacy policies for your own users). CraftAndShip does not review your application for legal compliance.

9. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, including the Acceptable Use provisions. We may also terminate accounts that have been inactive for an extended period with prior notice via email. You may close your account at any time by contacting support@craftandship.io.

Upon termination, your right to use the Service ceases immediately. If your application is hosted on our infrastructure, we will provide 30 days notice before taking down the hosted application, except in cases of serious abuse or legal requirement.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee that generated applications will be free of bugs or suitable for any particular purpose. AI-generated code may contain errors, and you are responsible for reviewing and testing your application before relying on it in production.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAFTANDSHIP'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO CRAFTANDSHIP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL CRAFTANDSHIP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless CraftAndShip, its owner, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or any application you create through the Service.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Texas. The arbitrator's decision shall be final and binding.

Class action waiver. You agree that any arbitration or legal proceeding shall be conducted on an individual basis only, not as a class action or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Small claims exception. Either party may bring an individual action in small claims court if the claim qualifies.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

15. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days advance notice via email to the address associated with your account. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you may close your account before they take effect.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CraftAndShip regarding the Service and supersede all prior agreements and understandings.
